This Privacy Policy describes the treatment of information collected by CoWorx from natural persons, and applies to all ways we collect information, including on our websites, through the online account portals, through the Jobs On Demand, and other similar apps and websites that assist in your employment, whether in email, text, or other electronic communications, and through personal communications, mail, or telephone. We follow this Privacy Policy in accordance with applicable law in the places where we operate. By continuing to provide your personal information to CoWorx, including accessing, browsing, or using CoWorx’s website, you are accepting the terms of the data practices detailed this Privacy Policy. We reserve the right to update or revise this Policy from time to time in our sole discretion. You are encouraged to review this Policy periodically for updates and changes.

Please keep in mind that our website and applications may contain links to other sites not owned or controlled by us and we are not responsible for the privacy practices of those sites. When you provide information to us on a third-party site or platform (for example, via separate job application websites such as Indeed), the information you provide may be separately collected by the third-party site or platform. Because such sites are not hosted or controlled by us, we are not responsible for the content or privacy practices of those sites. As a result, we encourage you to review the privacy policies of each of those other sites.

Only the information we collect is covered by this Privacy Policy. Information collected by a third-party site or platform is subject to the third-party’s privacy practices. Privacy choices you have made on a third-party site or platform will not apply to CoWorx’s use of the information we have collected.

CoWorx collects two basic types of information: personal information (information that identifies you as an individual or relates to an identifiable individual or household) (“Personal Information”), and anonymous information which is information that does not identify an individual applicant (“Anonymous Information”).

How we collect information

We collect personal information directly from you when you apply for a job with us or, if hired, with one of our recruiting clients. This includes responding to a job posting, supplying information for your benefit elections, carrying out human resource administration or in context of your employment with us. We also collect information when you create an online an account, sign up for communications from us, and during communications between us whether carried out via text, email, or on some other electronic communication platform or application.

We may also acquire your personal information from third party sources including through running background, consumer, and employment eligibility verification checks, and/or from information provided by references you listed on your job application, as well as from publicly available sources of information.

We also indirectly and passively collect information provided by your web browser when you visit our websites and applications. We, or a service provider that operates the services or any features therein, collect, store, and process information that is automatically collected when you use or access CoWorx’s websites. We (or such service provider) automatically collect Internet protocol (IP) address information (e.g., browser type and date/time stamp) when you access services. It is possible that we (or such service provider) would be able to identify you by a combination of your IP address and other information.

The way we use your information
Personal Information

CoWorx collects and processes personal information from applicants for employment with CoWorx, to make employment decisions that involve you and determine your eligibility for temporary staffing employment and/or full-time employment with CoWorx, and, if hired, to fulfill human resource, employment, and benefit administration purposes, where necessary to comply with any local, state, and federal legal obligations and laws,  for  the maintenance of your online account,  its personalization, and provided preferences. We may also use the personal information collected to maintain your employee account with us or provide you with employment as a temporary worker with another entity.

Anonymous Information

Anonymous Information means information that does not identify an individual applicant. We may also use Anonymous Information to create aggregate information. Aggregate information means information about groups or categories of applicants and/or visitors to our website, which does not identify and cannot reasonably be used to identify an individual job applicant, employee, or website visitor (“Aggregate Information”). CoWorx uses anonymous data to maintain, operate, and improve our websites, including to analyze website traffic and run analytics. We may also use anonymous and aggregated information to analyze its business performance, including for pay equity reports.

Sharing your information with others

We may share your personal information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract.

We do not sell personal information.

Rights for California Consumers

Under applicable laws, you may have specific rights regarding their personal information. This section describes such rights and explains how to exercise those rights.

Right to know

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the “right to know”). Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of sources for the personal information we collected about you.
  • Our business purpose for collecting or selling that personal information.

Right to delete

California residents also have the right to request we delete your Personal Information that was collected from you and retained, subject to certain exceptions. Once we have received and verified your identity and request, we will delete your Personal Information from our records, unless an exception applies.

We may deny your deletion request, in whole or in part, if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will respond to your requests within the applicable time periods and in the manner prescribed by the CCPA and CPRA. You may only make a verifiable consumer request for data portability twice within a 12-month period.

In connection with any privacy-related requests you submit to us in exercising rights to which you are entitled under applicable law, we will undertake steps to verify your identity. We may ask you to provide information that we have on file about you or, if the request is submitted in writing or electronically, we may contact you via another method (e.g., telephone) to verify your identity. We will only use Personal Information provided in a request to verify the requestor’s identity and authority to make the request and we will maintain a record of any such requests as required by law. If we are unable to verify your identity, we will not be able to fulfil your request.

Retention of Personal Information

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymize your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

Once you are no longer an employee or contractor of CoWorx Staffing Services LLC, we will retain and securely destroy your personal information in accordance with CoWorx Staffing Services LLC’s record retention policies.

Data Security

While no data security system can fully protect personal information from unauthorized data breaches, CoWorx Staffing Services LLC has implemented reasonable safeguards and controls, consistent with its legal obligations for local, state and federal laws within the US. 

CoWorx Staffing Services LLC is committed to: (i) seeking to safeguard all personal information that you provide to us; (ii) seeking to ensure that it remains confidential and secure; and (iii) taking all reasonable steps to ensure that personal privacy is respected.  All our data is stored in written or electronic form on our servers and computers and in various physical locations. We maintain physical, electronic, and procedural safeguards to protect your personal information from misuse, unauthorized access or disclosure and loss or corruption by computer viruses and other sources of harm.  We restrict access to personal information to those staff members, CoWorx Staffing Services LLC and third parties who need to know that information for the purposes identified in our notice(s).

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.
